New Delhi, May 9 (). A Delhi court on Tuesday sentenced seven years’ imprisonment to nine people who were convicted in a case related to the 2020 north-east Delhi riots in March.
Additional Sessions Judge Pulastya Pramachala observed that the acts of Mohd Shahnawaz alias Sanu, Mohd Shoaib alias Chhutwa, Shahrukh, Rashid alias Raja, Azad, Ashraf Ali, Parvez, Mohd Faisal and Rashid alias Monu created a sense of insecurity among the people and created an atmosphere of insecurity in the society. Endangered communal harmony.
The judge observed, ..all these convicts have been convicted for offenses punishable under sections 147/148/380/427/436 read with section 149 IPC as well as under section 188 IPC. He has been indicted against the charges during the night. All of them belonging to the Muslim community and their other accomplices (unknown) had made an unlawful assembly by intervening between 12 midnight on February 24, 2020 and February 25, 2020 at Chaman Park, Shiv Vihar, Tiraha Road, Delhi.
The court said that the object of which was to cause maximum damage to the persons of Hindu community as well as their properties and to create fear and insecurity in the minds of the members of Hindu community and this mob including the above accused persons committed vandalism, theft and damage to House No. A. Committed nuisance by setting fire to -49A.
The court has also imposed a fine of Rs 21,000 each on the nine convicts and directed Rs 1.5 lakh out of the total amount to be distributed as compensation to the complainant/victim.
All fines shall be recoverable as per section 421 read with 431 CrPC, the court said. Offenders will be entitled to benefits under section 428 of CrPC. All the sentences will run concurrently.
The court said: Communal riot is a danger which poses a serious threat to the feeling of brotherhood among the citizens of our country. Communal riots are considered to be one of the most violent forms of public disorder that affect society. Not only does it cause harm. There is loss of life and property, but the social fabric is also badly damaged. During communal riots innocent common people get caught in circumstances beyond their control, which also leads to violation of human rights.
In this case also, the court observed that the convicts were involved in communal riots, the effect of which was not only confined to the people living in the affected area, but it also affected the mindset of the people in the society beyond the limits of the area.
Thus, the impact of the offense committed by the convicts in this case is not limited to the damage caused to the complainant, but their acts have left a deep scar on the social fabric and economy and stability of our country. The court said that the alleged acts created a sense of insecurity among the people, while endangering the communal harmony in the society.
