The Delhi High Court has upheld the personality rights of Bollywood actress Aishwarya Rai Bachchan, prohibiting online platforms from unlawfully utilizing her name and images for commercial purposes. The court indicated that the unauthorized use of a well-known individual’s identity can not only cause financial harm but also infringe upon their right to maintain dignity. Justice Tejas Karia stated in a ruling issued on September 9, made public on Thursday, that the courts must not ignore cases of unauthorized exploitation of personality rights and should protect affected individuals to prevent any resulting harm. The high court noted that Rai has presented a prima facie case warranting an ex-parte injunction.
It highlighted that the balance of convenience favors the plaintiff, and failure to grant an injunction could result in irreparable damage to her and her family, both financially and in terms of their dignity. The interim order was granted following Rai’s request to safeguard her personality rights and prevent online platforms from misusing her name, images, and AI-generated pornographic content.
