Kolkata, May 5 (). A two-member division bench of the Calcutta High Court on Friday upheld the decision of a single bench of the same court which said that Aalo Rani Sarkar, the Trinamool Congress candidate in the 2021 assembly elections, is a Bangladeshi citizen.
Aalo Rani Sarkar was the 2021 candidate from Bangaon (South) seat in North 24 Parganas district. She lost to BJP’s Swapan Mazumdar by 2004 votes.
He challenged the election result in the Calcutta High Court before a single bench of Justice Bibek Chowdhary. The lawyer of the winning candidate presented evidence in favor of his Bangladeshi citizenship after which the court rejected his plea.
Mazumdar’s lawyer presented documents in the court certifying that Sarkar’s name is in the voter list of Bangladesh. The government’s lawyers failed to present any concrete evidence against it. Justice Chowdhary then dismissed his plea and ruled that he was not an Indian citizen.
The single bench said that the Indian Constitution does not allow dual citizenship. He ordered the Election Commission of India to take action in the matter.
The government challenged the single bench decision before a two-judge bench of the High Court itself, comprising Justice Subrata Talukdar and Justice Supratim Bhattacharya.
The division bench has also upheld the decision of the single bench.
