Delhi High Court dismisses PIL seeking inclusion of legal education in schools

Delhi HC posts to April 20 hearing in plea seeking declaration of PM CARES Fund as 'State'

New Delhi, May 8 (). Dismissing a plea seeking legal studies as an optional subject in every school, the Delhi High Court on Monday said inclusion of any subject in the curriculum is within the purview of the executive and courts will decide on such issues. Not a forum to judge.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramaniam Prasad while dismissing the petition remarked that if such petitions are allowed, tomorrow someone will file a petition for astrophysics in the syllabus.

The bench said, where is the right to demand that this particular section be made part of the syllabus? Tomorrow some kid will come to us and say that I had astrophysics as a subject.

The PIL filed by Virender Kumar Sharma Punj and Shubham Pushp Sharma through Advocate Meghvarna Sharma was supported by citing a 2013 article where it was stated by the Central Board of Secondary Education (CBSE) that 200 schools will introduce Class XI on a pilot basis. And legal studies will be offered as a subject for class XII.

The lawyer said that the government has not done anything special in this regard till date.

The counsel further submitted that subjects like Artificial Intelligence (AI) have been made a part of the curriculum and the students whom the petitioner has met also wish to study law.

For those who want to connect with the Constitution, Additional Solicitor General (ASG) Chetan Sharma pointed out that the government has initiatives like Know Your Constitution.

After this, the court refused to pass any order in this regard.
