New Delhi, April 21 (). The Supreme Court on Friday sought response of the central and state governments on a PIL seeking direction to adopt a uniform and fair compensation policy for victims of mob lynching in the country.
A bench of Justices KM Joseph and BV Nagaratna observed that, in public interest as well as implementation of the directions issued by this Court in the case of Tehseen S. Poonawalla v. Union of India and others (2018), filed by Indian Muslims for Progress and Reforms Has been done
Counsel for the petitioner, Advocate Javed R. Shaikh drew the attention of the court to the relevant portion of the above judgment which directed that a scheme with the objective of providing compensation to the victims in cases of lynching/mob violence under Section 357A of the State Code of Criminal Procedure, 1973 will draw.
He submitted that some states have prepared a plan while many states have not done so till date. The apex court in its order said- It was further submitted that the said judgment had laid down guidelines as to how the victim compensation scheme should be framed as the nature of physical injury, psychological injury and loss of earning has to be determined by the State Governments. as well as due consideration has to be given to other factors such as loss of educational opportunities and costs due to mob lynching/mob violence.
In this regard, it was submitted that as the State Governments have to pay due attention to the nature of physical injury, psychological injury and loss of earnings as well as other factors like loss of educational opportunities and expenses due to mob lynching/mob violence Have to give
After hearing the counsel, the bench said, “We issue notice to the respondents.” The respondents are directed to file their respective affidavits with regard to the implementation of the directions issued in the above matter and the manner in which it has been done. The said affidavit shall be filed within a period of eight weeks from the date of service of the notice.
