Senior advocate Siddharth Luthra, appearing for Sunita Nareddy, daughter of Vivekananda Reddy, told Justice J.K. Maheshwari and P.S. Narasimha told the Bench that the CBI in its reply has said two things: The High Court has no power to grant bail under Section 482 of the CrPC and it sets a bad precedent.
Earlier this week, on the last day of the hearing, Additional Solicitor General (ASG) Sanjay Jain, representing the CBI, told the apex court, “We have never heard that an order which cancels bail, allows bail.” Is. How is this possible? This is inherently contradictory.
The bench said that the operative part of the order of the High Court, which directed the CBI court at Hyderabad to release the petitioner on bail on July 1, 2023, on a personal bond of Rs 1 lakh and two bonds of Rs 1 lakh each, will come up for the next date of hearing. Till date it will be banned. Senior advocate Aman Lekhi appeared in the court for Yera Gangi Reddy.
The top court was hearing a petition filed by Sunitha Nareddy challenging the High Court order granting conditional bail to T. Gangi Reddy alias Yera Gangi Reddy while allowing the bail cancellation plea. On May 18, the Supreme Court had issued notice to the CBI and the accused on a petition against the High Court order.
The accused has also challenged the High Court’s order canceling the bail, which the apex court has fixed for hearing in the second week of July.
The Telangana High Court, former Andhra Pradesh minister Y.S. The bail of Yer Gangi Reddy, the prime accused in the murder of Vivekananda Reddy, was cancelled. The high court said that since the CBI is about to complete the trial on June 30, Gangi Reddy can be granted bail on July 1 on a personal bond of Rs one lakh. The Supreme Court had recently extended the deadline till June 30 to complete the probe in this sensational case.
Former Chief Minister of Andhra Pradesh Y.S. Rajasekhara Reddy’s brother Vivekananda Reddy (68) was murdered at his residence at Pulivendula in Cuddapah district on 15 March 2019, a few weeks before the elections. He was alone at home when unknown persons killed him.
The CBI took over the investigation in the case in 2020 on the directions of the Andhra Pradesh High Court while hearing a petition by Sunita Nareddy, daughter of Vivekananda Reddy. Sunita had raised suspicion of murder on some relatives. The Supreme Court transferred the case to Hyderabad in view of the doubts raised by Sunita Nareddi about fair trial and investigation in Andhra Pradesh.
