New Delhi, May 1 (). The Supreme Court on Monday refused to stay the drive against encroachment in South Delhi’s Tughlakabad area.
Justice Sanjeev Khanna and Justice M.M. Sundresh issued notices to the Centre, the Archaeological Survey of India (ASI) and the Delhi Development Authority on a petition filed by some residents affected by the demolition drive to remove encroachments.
Senior advocate Colin Gonsalves, representing the residents, insisted that it is a humanitarian problem and an order has been passed to vacate the areas around Tughlaqabad Fort. He said that an alternative resettlement has been offered by the Delhi government to the residents.
The top court said it will hear the matter first on Tuesday. Gonsalves said about 1,000 homes are already gone. Along with this, there is news of more houses being demolished. He urged the court to restore status quo ante.
The apex court refused to grant any stay regarding the demolition drive and issued notice to the central government and others.
Earlier in the day, Gonsalves asked Chief Justice of India D.Y. The matter was mentioned before a bench headed by Chandrachud. The Chief Justice allowed Gonsalves to mention the matter before Justice Khanna.
