New Delhi, March 28 (). The Delhi High Court on Tuesday issued summons to Shiv Sena (UBT) chief Uddhav Thackeray, MP Sanjay Raut and MLA Aditya Thackeray in a defamation case. Maharashtra Chief Minister Eknath Shinde faction leader Rahul Ramesh Shewale had filed a defamation case, in which this summon has been issued.

Shewale had filed a defamation case against all three for certain statements. The Shiv Sena (UBT) alleged that the Shinde-led Shiv Sena faction bought the party’s election symbol for Rs 2,000 crore.

Senior advocate Rajeev Nair, appearing for Shewale, requested the court to pass an injunction restraining him from making any further defamation. Justice Prateek Jalan said that any order would be passed only after the response of the parties.

The court said that Mr. Nayyar, I am not for a moment commenting whether the allegations are true or false. It has also sought responses from respondents including Google and Twitter. Justice Jalan listed the matter for further hearing on April 17.

During the hearing on Tuesday, the court, while making oral remarks, said that these political fights are going on. As far as institutions are concerned, they have to stand up for themselves. The shoulders of the Election Commission are broad enough to deal with all this. Like courts, people talk all kinds of things about courts.

When Nair asked the judge whether the conduct of the defendants was troubling his conscience, Justice Jalan said, “The question is whether a person is entitled to torment my conscience?”

The question is not whether it stirs my conscience or not. The question is, in the free market of ideas, do people have the right to say such things which can shake my conscience? Ultimately they have to stand on their own feet.

The court said that it wanted to give an opportunity to the respondents and to know the reply before giving prima facie findings at this stage of issuing summons.
