New Delhi, April 24 (). The Supreme Court on Monday agreed to hear a plea seeking probe into the murder of gangster-turned-politician Atiq Ahmed and his brother Ashraf. Although he has said that five judges are not available due to corona and hence the hearing will be held on Friday.
The petition has sought a direction to constitute a committee headed by a former Supreme Court judge to probe the murder of the two brothers that took place on April 15.
Chief Justice Justice D.Y. A bench headed by Chandrachud told the lawyers at the time of mentioning the cases that five judges had got corona infection.
He said, since five judges are not available, some cases which were given hearing dates have not been included in the list. We will try to include them in Friday’s list.
Advocate Vishal Tiwari has filed a petition demanding investigation by an impartial expert committee in the Atiq-Ashraf murder case. Along with this, he has also demanded an inquiry into 183 encounters in Uttar Pradesh since 2017.
Tiwari mentioned the petition for hearing on Monday before a bench comprising Justice P.S. Narasimha is also included.
Atiq and Ashraf Ahmed were shot at by three assailants on April 15 when policemen were taking them for a check-up to a medical college in Prayagraj. All three had come there as journalists.
The petitioner also sought an inquiry into the custodial killings and asserted that such acts by the police pose a grave threat to democracy and law and order and lead to policia polity.
The petition states that killings or fake police encounters have no place in law except on judicial orders. In a democratic society, the police cannot be allowed to become an instrument of final justice, as the power of punishment is vested only in the judiciary.
