The Supreme Court held that the Government of Delhi should have control over bureaucrats in the administration of services except in areas outside the legislative powers of the NCT.

The court said that the Lieutenant Governor is bound by the aid and advice of the Government of NCT except in matters relating to land, public order and police.

A five-judge bench headed by Chief Justice of India DY Chandrachud said that the principle of democracy and federalism is a part of the basic structure. Federalism ensures the existence of diverse interests and accommodates diverse needs.

The Supreme Court held that the Delhi government has legislative power over public order, police and services except land.

The bench said that if the services are kept out of the legislative and executive domain, the ministers would be excluded from controlling the civil servants who have to implement executive decisions.

Following the Supreme Court order, AAP minister Gopal Rai said the chief minister would hold a meeting with Delhi government ministers at 2 pm to discuss the future course of action.

Rai said that the Supreme Court’s decision was a tight slap to the BJP. The task of usurping the office of the Delhi Government was done by the Central Government through the Lieutenant Governor and the Ministry of Home Affairs.

The BJP government was pushing democracy into darkness by destabilizing the governments. The Supreme Court has done the work of showing light.

Meanwhile, AAP minister Saurabh Bhardwaj said the Supreme Court has slapped the central government for taking away the rights of the people of Delhi.

Addressing a press conference at the party headquarters along with Rai and Atishi, Bhardwaj said that the people of Delhi bow before CJI Chandrachud ji, he has returned the rights of the people. CJI DY Chandrachud has emerged as a hero in the country.

He also said that Chief Minister Arvind Kejriwal has won the battle of the people of Delhi which was going on since 2014.

Bhardwaj said that whenever calamity befalls the country and the Constitution is kept in abeyance, there is an institution (Supreme Court) which will establish order and save the country. This decision will be remembered.

Atishi, a minister in the AAP government, said that if the powers of the elected government are taken away, then the vote of the people has no meaning. Today the Supreme Court has slapped the BJP government. If the central government takes away the powers of the democratically elected government, then the Supreme Court stands up to save the Constitution. Today the Supreme Court has saved democracy and the Constitution.

He also said that the Lieutenant Governor has only the right to see the paper, he has no right to take a decision on it.
