Allahabad High Court to Review UP Government's Compassionate Appointment Appeal

The Allahabad High Court has agreed to review an appeal brought by the Uttar Pradesh government concerning a compassionate appointment. A bench comprising Justices Manoj Gupta and Arun Kumar acknowledged the delay in the appeal’s submission and has stayed a previous ruling made by a single judge on April 18, 2025. The court has scheduled the case for hearing in the week starting October 6, 2025. Chief Standing Counsel Ratan Deep Mishra indicated that a key requirement for a compassionate appointment is that the spouse of the deceased government employee must not be employed.

In this case, the deceased employee’s wife was an Assistant Teacher at the time of his passing, and their son Rahul submitted the application for the appointment. Mishra noted that according to Rule 6, which details the process for applying for employment, the applicant must reveal various details, including the family’s financial situation. Therefore, it was essential for the petitioner-respondent to disclose his mother’s employment as an Assistant Teacher and her income. The bench noted that the mother of the respondent provided an affidavit on July 29, 2008, stating that if her son were employed, he would support the family, but she did not mention her own employment status.
