New Delhi, April 17 (). The Delhi High Court on Monday directed the ministries concerned to file their response to a plea seeking linking of documents of movable and immovable property with Aadhaar numbers.
A division bench of Chief Justice Satish Chandra Sharma and Justice Yashwant Verma was hearing a petition filed in the year 2019 by BJP leader and advocate Ashwani Kumar Upadhyay.
The bench sought response from the Union Ministry of Finance, Ministry of Housing and Urban Affairs (MoHUA), Ministry of Rural Development and Ministry of Law.
During the hearing, the court noted that the registry has pointed out certain defects in Upadhyay’s application and then directed him to rectify them.
The bench also asked the government officials to file a reply.
Additional Solicitor General (ASG) Chetan Sharma, appearing for the Centre, said the matter brings to the fore an important issue.
It is the case of the petitioner that linking of movable and immovable properties with the Aadhaar number of the owner would curb corruption, black money and benami transactions.
Upadhyay said that in the light of Article 21 of the Indian Constitution, the government is bound to take appropriate steps to curb corruption and black money and confiscate benami properties.
Black money holders will be forced to declare their unaudited movable and immovable assets and it will take years to regenerate that amount of benami property. Thus, it will help in eliminating the generation of black money in the long run.
Talking about the annual growth, Upadhyay claimed that if the government made it mandatory to link property documents with Aadhaar, it would increase by two per cent.
“(Linking of Aadhaar with property documents) will clean up our electoral process, which is dominated by black money and benami transactions and thrives on the cycle of black investment, capturing power through unfair means,” the plea said. , Uses political power to amass private wealth, all with disdain.
The bench listed the matter for further hearing on July 18, 2023.
