Lawyer Justifies Shoe Attack on Chief Justice, Cites Emotional Distress

Lawyer Rakesh Kishore, who attempted to throw a shoe at Chief Justice of India (CJI) BR Gavai within the Supreme Court, defended his actions on Tuesday, citing emotional distress and hurt from comments made by the CJI during a prior hearing on a religious issue. Following this incident, the Bar Council of India promptly suspended his legal license. The shocking occurrence took place during a case mentioning session presided over by Justice Gavai. Kishore allegedly approached the bench, removed his shoe, and attempted to throw it at the judges, but security intervened before he could. In a statement to ANI, Kishore expressed that he acted out of pain and protest, claiming the CJI disrespected religious sentiments.

He referred to a previous remark, stating, “The CJI should appreciate the dignity associated with the term ‘Milord’. He travels abroad criticizing bulldozer actions in India — are those actions truly unjust?” He further mentioned that during a hearing on September 16, the CJI reportedly mocked a Public Interest Litigation (PIL) concerning idol worship by allegedly stating, “Ask the idol to restore its own head.” Kishore claimed this remark was deeply offensive to him. The 71-year-old accused the judicial system of bias against certain communities, referencing instances such as the Haldwani encroachment case and comments made regarding Nupur Sharma.

He also criticized the Supreme Court’s approach to matters relating to Sanatan Dharma, like Jallikattu and Dahi Handi, asserting undue interference in Hindu customs. Kishore denied any influence from intoxication, stating that his actions stemmed solely from emotional upheaval. He asserted that he neither fears repercussions nor regrets his actions, calling on the nation to reflect on what led “a non-violent, honest person” to such behavior. Identifying himself as Dr. Rakesh Kishore, the lawyer, who possesses degrees including MSc, PhD, and LLB, also made contentious remarks concerning caste and religion, claiming the incident was about “mindset” rather than community identity. Prime Minister Narendra Modi condemned the attack, stating it had upset the entire nation.

He also commended CJI Gavai for his composure and dedication to justice and constitutional principles. The Supreme Court Bar Association and various leaders have strongly denounced the act, highlighting that such conduct undermines the dignity of the judiciary.
