New Delhi, May 18 (). The Supreme Court on Wednesday appointed Manipur High Court Acting Chief Justice M.V. Muraleedharan said that despite being given the opportunity, he did not correct his decision to give quota to the majority Meitei in Manipur.
Chief Justice D.Y. Chandrachud said the High Court order was wrong and I think we have to stay the High Court order… We gave Justice Muralitharan time to correct himself and he didn’t.
Justice P.S. Narasimha and J.B. Pardiwala said the direction was against the principles laid down by previous judgments of constitutional benches of the Supreme Court, which pertained to the classification of communities as Scheduled Castes or Scheduled Tribes.
The apex court did not stay the High Court order as it was informed that an appeal against the same is pending before a division bench of the High Court.
The top court said this after noting that an application was filed by the Manipur government before a bench of Acting Chief Justice Muraleedharan, and the bench asked the state to comply with its March 27 direction to grant ST status to the Meiteis. The deadline was extended.
The tribals have been protesting against reservation for Meites following a March 27 Manipur High Court order asking the state government to send a recommendation to the Center within four weeks on the demand for granting ST status to the community.
The bench said that the tribals, including Kuki, can participate in the proceedings before a division bench of the High Court.
