On Thursday, the Supreme Court permitted the transfer of an alleged hit-and-run case involving a probationary judicial officer from a court in Punjab to the Rohini trial court in Delhi. A bench comprising Justices Surya Kant and Joymalya Bagchi made this decision following claims from the deceased’s family regarding bias in the trial, given that the accused is a judicial officer. During the proceedings, the judicial officer’s counsel expressed no objection to the transfer to a Delhi court but suggested that Noida in Uttar Pradesh would be more suitable, as the victim’s sister-in-law practices law in Delhi. Nonetheless, the bench opted to move the trial to a court presided over by an additional chief metropolitan magistrate.
Additionally, the court transferred another case in which the victim’s wife requested the transfer of the investigation from Punjab Police to the CBI, stating that if further investigation is warranted, it will be conducted by the Delhi Police. The Supreme Court also moved the Motor Accident Claim Tribunal case from Kullu in Himachal Pradesh to a court in Delhi. The deceased’s wife asserted that her husband died in a hit-and-run incident in February of this year involving the judicial officer’s vehicle while the officer was serving as a probationer in Hoshiarpur district, Punjab. It was noted that the case was pending at the charges framing stage before the judicial magistrate in Phagwara court in Punjab.
