New Delhi, May 16 (). Former AAP leader Tahir Hussain has filed a petition in the Delhi High Court seeking quashing of an FIR lodged against him for his alleged involvement in the 2020 riots.
Justice Vikas Mahajan fixed May 25 for the hearing.
However, the counsel for Delhi Police was not available.
Hussain’s counsel, advocate Tara Narula, argued that the trial in the matter has not yet started and there is already another FIR related to the same incidents.
The judge said that there is a difference between the two cases, both the cases were registered in 2020.
The current FIR pertains to rioting charges, while the other FIR involves Section 302 (murder) of the Indian Penal Code.
Narula said that the other FIR is more comprehensive and covers the FIR as well. He insisted that there is no time limit to file a petition for quashing of the FIR.
According to the petition, both the FIRs have alleged rioting on February 25, 2020, between 4 and 5 pm, with allegations of Hussain’s involvement and use of his terrace for petrol bombs.
As per the petition, the present FIR, registered on February 28, 2020, focuses on the burning of shops, while the second FIR, registered on February 26, 2020, focuses on Intelligence Bureau personnel Ankit Ankit in the vicinity of the Chand Bagh Pulia area. Sharma’s murder.
The plea argued that there is significant overlap in the investigation of both the FIRs registered at Dayalpur police station, including common witnesses.
It was further argued that the sequential registration of FIRs violates the law and the fundamental rights of the accused.
