New Delhi, April 17 (). The Supreme Court on Monday refused to entertain the Kerala government’s plea challenging the state High Court order asking it to send a rogue elephant to the Parambikulam Tiger Reserve in the state’s Palakkad district Was.
Earlier in the day, on a petition moved by the Kerala government, Chief Justice D.Y. A bench headed by Chandrachud decided to hold the hearing.
During the hearing, Justice P.S. Narasimha and J.B. Pardiwala said that the High Court considered the view of the expert committee and passed a reasoned order. However, the state government insisted that the elephant should be sent to a training center after it had killed seven people and destroyed several houses.
The bench told the counsel for the Kerala government that the experts have refused to interfere with the High Court order that the elephant needed to be shifted. It further said that the committee has given some suggestions and the state government cannot consider the same.
The state government argued that it had been given a week’s time by the High Court to shift the elephant to an alternate location, and if the state government failed, it would have to be shifted to Parambikulam.
The lawyer insisted that the government had taken the decision to shift the elephant to a training center after the elephant had killed people and destroyed several houses.
After hearing the arguments in the matter, the bench refused to entertain the appeal of the state government against the order of the High Court.
The Kerala High Court last week refused to review its decision to transfer the rice-eating elephant to the Parambikulam tiger reserve.
The high court had on April 5 directed the elephant to be shifted to a tiger reserve as suggested by the expert committee.
